Due process of law

n. a fundamental principle of fairness in all legal matters, both civil and criminal, especially in the courts. All legal procedures set by statute and court practice, including notice of rights, must be followed for each individual so that no prejudicial or unequal treatment will result. While somewhat indefinite, the term can be gauged by its aim to safeguard both private and public rights against unfairness. The universal guarantee of due process is in the Fifth Amendment to the U.S. Constitution, which provides “No person shall…be deprived of life, liberty, or property, without due process of law,” and is applied to all states by the 14th Amendment. From this basic principle flows many legal decisions determining both procedural and substantive rights.

The ENTIRE POINT of due process is that it must be staunchly defended no matter how many emotions are involved. Humans tend to make decisions based upon misguided feelings rather than facts, so due process provides protection from our primal ape instincts.

Americans are easily misled and manipulated by the media, revealing an embarrassing lack of critical thinking skills to the world on a daily basis. Our nation would be much better off if we simply taught HOW to think rather than what to memorize. If you can’t extend due process to your enemy, then you simply do not grasp the meaning of the Constitution or the concept of what American law was designed to represent. If you want to deprive others of due process, then the tyranny will eventually extend to yourself, and you will deserve whatever happens to you, because you put a lot of energy into securing your enslavement.
